High Court Restrains Classic Legends From Selling Motorcycles with Yezdi Name

The Karnataka High Court has made a judgment that the ‘Yezdi’ brand name is owned by Ideal Jawa, and ordered the official liquidator to auction it.

Yezdi and classic legends are in the news, and not exactly for the right reason. A 90-page judgment of the Karnataka High court has ruled that the Ideal Jawa is the owner of the Yezdi trademark.

Thus, Restraining the use of the name by Mahindra-backed Classic legends, a company that has revived this iconic motorcycle brand in the 21st century.

Ideal Jawa was the company that used to manufacture and sell Yezdi motorcycles till the mid-1990s, but in 1996 it was ordered to be liquidated. And all the assets were conferred to the official liquidator.

The High court has ordered the official liquidator to sell the trademark in a public auction and fined Boman Irani (co-founder of classic legends) and Classic Legends Pvt Rs. 10,00,000 each.

The High Court has ruled, all trademark registration certificates issued in favor of Irani for use of the Yezdi brand name as nonbinding. Also, directed the Trademark Registration Authority to transfer all such registrations to Ideal Jawa.

As of now, the court has kept the order in abeyance for a month to allow classic legends and its co-founder Boman Irani to file an inducement.

During this period the trademark Will remain in Karnataka high court’s possession.

“The order is held in abeyance and the company is seeking legal advice on the matter. The company will be filing an appeal against the order shortly and is optimistic about securing favorable relief. In the interim, manufacturing and sale of motorcycles will continue, subject to orders of the Appellate Court,” Classic Legends Private Limited has said in a statement. Source ~ car & bike

Currently, Mahindra-owned Classic Legends offers three different models for the Yezdi Brand, a cruiser, a scrambler, and an Adventure.

The latter two are aptly named and the cruiser is sold by the name of Roadster.

All three of these models share the same engine which produces 30 horsepower albeit in different states of tune as demanded by their segment and the character of the motorcycle.
